Olena Yaliieva provided an expert assessment of the draft Law of Ukraine "On the Basic Principles of State Climate Policy"

During the second session of the II Forum on Ecology and Sustainable Development organized by Legal Practice, Pragma's counsel Olena Yaliieva provided an expert assessment of the draft Law of Ukraine "On the Basic Principles of State Climate Policy", highlighting five main challenges to consider when shaping and implementing state climate policy:

  • Green development should be achieved through technology improvement rather than deindustrialization and should consider the need for economic development.
  • Given the numerous strategic documents and proposed bills, it's crucial to ensure their consistency at all levels.
  • It's necessary to consider the possibility of introducing instruments similar to the European CBAM alongside climate preservation measures to ensure the competitiveness of domestic producers and prevent carbon leakage.
  • Ensuring the accessibility of state aid mechanisms, including by aligning relevant provisions of climate legislation with existing legislation on state aid.
  • Establishing achievable, well-defined goals that reflect current conditions in Ukraine and do not limit development and recovery.
